| TERM OF AGREEMENT |
By this particular instrument,
- on one side, as lecturer thus identified henceforth Infonet Business Ltda., headquartered in Sao Paulo-SP, Rua Condessa Siciliano, 85 Jardim São Paulo;
- on the other side, as adherer thus identified henceforth Available.me user,
- have each other, right and set the following:
1. The lecturer is a company focused on the promotion of private interests of individuals, including, the now adherer agree, by registering on "Available.me", forcing the adherer to observe and respect, unquestionably, the therms and conditions applicable to an end, object of this adjustment.
2. Based on this premise, the adherer declares to be over eighteen (18) years old, may respond civilly and criminally for falsity, it might be investigated at any time and mode, confirming further that:
a) Agree, unquestionably, the terms and conditions concerning this accession, including every and any change made by lecturer, with or without prior notice or involvement, valid for a period of use of the site, starting from the date of registration;
b) the basic users features can be changed without notice, the price and the payment method for the full use of Available.me are specified on the signature page, through previous payment;
d) the user will respond civilly and criminally for eventual falsehood especially regarding personal identification, relayed to the lecturer;
e) the user will indemnify the lecturer of any expense, judicial or extrajudicial, arising from relationships with others, derived from the use of the site;
f) the user has absolute knowledge about the possibility of use of pictures uploaded on Available.me by others,
g) it is the user responsibility, without participation or onus of the lecturer, the result of any personal relationship;
h) It is users responsibility of any retransmission of pictures uploaded to internet, answering, similarly, for any improper procedure and inappropriate, using the insulting remarks, threatening, violate the rights of others;
i) the user will act in strict, unquestioning obedience to the current legal provisions, the user will not use any offensive language, make apology to illegal practices, and will not disclose, under any circumstance, phone number, personal URL, email and ICQ address;
j) the user will not disclose or promote products, services made by himself or by others, including distribution of unsolicited messages (spam), the user will not use the site to conduct any fraudulent activity including any "pyramid scheme";
k) the user will obtain in writing the authorization to disclosure of videos and audios, already approved by the lecturer;
l) the lecturer will remove any profile or material which might be deemed inappropriate or inadequate;
m) the user is aware that the lecture will take any measure, judicial or extrajudicial, in case of disobedience of the basic rules, relayed here, or any other procedure, offensive to order and to law;
n) the user know that will not receive any refound, even if, for whatever reason, there is withdrawal, caused by improper procedure;
o) the user knows that it is not allowed to copy, reproduce, publish, transfer, posting, broadcasting, recording, broadcasting, commercial. Available.me is for personal use only;
p) the user recognizes and confirms the possibility of interruption and suspension of availability for use of the site by the lecturer, which can be restored, without incurring any charge or expense from the lecturer, which may happen before system failure, whether for repairs or any other fortuitous event;
q) the user knows the possibility of failures of infrastructure, intervention government, war, civil unrest, kidnappings, fires, floods, accidents, fenômentos of nature, lightning, blackout, terrorist attack or any other procedure that somehow affects the lecturer, third parties, including service providers;
r) the user recognizes and ratifies the entry for the national judiciary of any dispute involving the adjustment now concluded, and especially the Jurisdiction to resolve any pending, will always be the county of São Paulo-SP, or domicile of lecturer;
and for being right and set, sign this instrument, confirmed with the use of Available.me
